A. Terms of Service for Educators
For purposes of this Section A of the Olexa Education, LLC (“OE”, “we” or “us”) Terms of Service, all references to “you” or “your” shall mean you, the individual or organization accessing this website in your capacity as an Educator or candidate. OE’s Terms of Service and Privacy Policy are incorporated herein by reference.
1. Information from Families
You acknowledge and understand that OE has no control over the content, accuracy or completeness of information provided by families seeking educators. In the event you are offered a position by a family, it is your responsibility to review all offer materials and other relevant materials provided by the family and to ask all questions and request all material and information you desire in order to determine if the family is a good fit for you, and it is your decision as to whether or not you accept the offered position and the terms of such offer.
You understand and agree that OE has no obligation to present you with any Job opportunities or refer you to any family as a candidate. We cannot confirm the accuracy or completeness of any information submitted by any family or other user. OE assumes no responsibility, and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of any job offers or other information submitted by any family or other user.
When you initiate a job inquiry via a website operated by OE, we may collect certain information about you and any actions taken by you during your visit using automated means, such as cookies and web beacons. The information collected includes, for example, your geographic location and IP address.
2. Resume and Other Information Provided by You
By uploading a resume or C.V. and/or providing information about yourself, your experience, education, qualifications, certification, citizenship and visa status, travel history and any other relevant topics on the OE website (collectively, “Your Resume” or “Applicant Resume”), you are requesting and authorizing OE to make available Your Resume to any family or individual that OE believes may have an interest in Your Resume. You warrant that the information on Your Resume is complete, truthful and accurate. You are responsible for keeping Your Resume accurate and up-to-date. You warrant that if at any time any of your teaching credentials, clearances or other requirements are limited, suspended, withdrawn, or otherwise adversely affected, you will immediately notify OE at info@olexaeducation.com
Applying to jobs or otherwise sharing Your Resume with OE may result in Your Resume being sent to prospective families. OE has no control over the actions taken by prospective families, such as copying Your Resume, publishing Your Resume and contacting You directly using information from Your Resume. You agree to defend, indemnify and hold OE harmless from and against any damages, claims or losses suffered by you or anyone else as a result of Your Resume being shared with prospective families and any actions taken by such families.
By creating or uploading Your Resume, you are requesting and authorizing OE to review or scan Your Resume and provide you feedback (in OE’s discretion), including suggested changes, positions you may consider applying to because your qualifications may match their requirements, and suggestions for additional information you may want to include with your application to a particular job. You agree that your use of any feedback or other information provided by OE is at your sole discretion. You are the only one responsible for deciding which jobs to apply to and what to include in your applications. OE assumes no responsibility and disclaims all liability for any actions you take based on any provided feedback. OE does not guarantee that any recommended jobs are suited for you.
It is your responsibility to review Your Resume to ensure that the content appears as you intend, and that it contains the right information or any information you intend to include or update. If you see any inaccuracy in any such material, it is your responsibility to correct such information or to contact OE to do so. It may take several weeks for updates to Your Resume to be reflected. OE assumes no responsibility and disclaims all liability for Your Resume or other information you post, send or receive through the Site.
By providing Your Resume to OE, you agree that OE may associate Your Resume data with other information. This includes your scores on any assessments you may have taken, your answers to any questions and any information that you choose to include, such as your desired salary, work schedule, citizenship status, academic credentials, whether you are ready to work, or other information publicly available or provided by You (collectively, “Candidate Information”). Candidate Information may be available to third parties, such as families.
To mitigate fraud, OE may mask or hide your contact information, for example, we may mask or hide your email address and/or phone number, from Your Resume, or application, and may substitute it with an alias. OE makes no promise to you about whether all or part of your contact info will be masked or hidden, and the decision to mask or hide such info is in OE’s sole discretion. OE may also mask some or all of the families’ contact information, or a family may choose to mask their contact information when they contact you. In either case, you agree to a prospective family contacting you from a masked phone number or email, and that you may not be able to return their call unless they provide their real number to you.
OE makes no guarantees regarding your job application experience, that your Resume will be shown to a particular family, that families will contact you, or that you will receive job interviews or job offers.
3. Applying to Jobs
You acknowledge and agree that families may request that OE assemble your application materials, resume, answers to screener questions, assessment responses and other information you provide to OE into one document, and you agree that in doing so, OE assembles these application materials on your behalf. We cannot guarantee that such application materials will be delivered, received, accessed, read or acted upon. OE also does not guarantee that any family will receive, be notified about, access, read or respond to any such resume or other application material, or that there will be no mistakes in the transmission or storage of the data. OE depends on the families to provide OE with the correct destination for all applications, and we cannot vouch for the validity of the contact information provided to us by families. If the electronic destination provided to OE is incorrect, your application materials will not be sent to the intended recipient of the application.
Available positions may expire, be filled or otherwise be removed between the time you submit your application and the time it is received, in which cases your application will be void. OE has no responsibility for expired or removed postings or for delivering applications prior to a posting’s expiration or removal. OE may store your application and related information regardless of whether a job has been closed or is no longer available.
By providing Your Resume or any other information to OE, you agree that OE is not responsible for the content of the family’s job application, requirements, messages, screener questions, skills assessments or their format or method of delivery, and that OE does not guarantee receipt of your application by the families, or your receipt of messages from the families. Please note that while OE may ask you questions on its own behalf or on a family’s behalf, OE does not choose the questions asked by families or decide the job qualification criteria of families. As your prospective employer or Employer, families are solely responsible for compliance with all applicable laws, including the Fair Credit Reporting Act and similar laws, anti-discrimination laws such as Title VII of the Civil Rights Act of 1964, as amended, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and any applicable data protection or privacy laws. Families are responsible for offering alternative methods of screening, if so required by the Americans with Disabilities Act or any similar law. You must contact OE if you require alternative methods of screening. Some questions may be labeled as optional, indicating only that the application may be submitted to the family without providing an answer. OE cannot guarantee that the family will consider such an application or make a particular determination with regard to such an application. As prospective employers, families may ask applicants to voluntarily self-identify certain demographic information such as race, ethnicity, sex, disability and/or veteran status along with their job applications, which is a separate process from OE’’s collection of demographic data from you. OE is not responsible for these questions. If you have questions or concerns about a family’s application materials, please contact OE immediately. OE cannot make any guarantee regarding health and safety measures in a family’s hiring or interviewing process. OE recommends you follow personal health and safety best practices as recommended by the World Health Organization or similar institution. OE does not guarantee the validity of a job offer and cautions applicants to verify the validity of a job offer before taking an adverse action regarding their current employment situations. Educators are solely responsible for verifying the accuracy of any information or job offer.
You acknowledge and agree that OE has no control over the conduct of any families. Any interactions the family has directly with you (for example, calling or emailing you directly instead of through OE) are not visible to OE. OE assumes no responsibility, and disclaims all liability, for the content, accuracy, validity, completeness, legality, reliability, or availability of any notices you receive from any family.
By answering screening or “knockout” questions, you acknowledge that families may have instructed OE to schedule interviews with prospective Educators who meet criteria (based on information the candidate has provided to OE, such as answers to screening questions, resume, teaching certifications and assessment responses) that the families have selected, and based on the families' availability. You agree that OE has no discretion in the transmission of these interview invitations and that the availability or criteria the family provided to OE may not be accurate. OE may request that candidates confirm their interest in the position before scheduling an interview. It is ultimately your responsibility to confirm whether any interviews were scheduled, or to reschedule or cancel interviews if necessary. The decision of who to interview is decided solely by the families, who can choose to interview any candidate at any time.
4. OE is not Your Employer.
You acknowledge and agree that OE is not and will not be your employer for any purpose; if you are selected by a family, you will be employed directly by that family and it is your choice to agree or not agree to any offered terms of employment. OE will not compensate you in any way, and OE is not responsible for complying with any employment laws, withholding or submitting any tax payments or other legally-mandated deductions, providing for unemployment insurance or workers’ compensation, or taking any other action that an employer may take in regard to your relationship with such employer. OE assumes no responsibility, and disclaims all liability, for the legality of any actions of any family, regardless of whether OE has introduced you to such family or otherwise assisted in your application for any position.
5. Health, Safety, Visas, Vaccines and Insurance.
You acknowledge and agree that OE is not responsible for you or any aspect of your wellbeing while working for a family or applying for a position with a family. It is your responsibility to obtain and maintain liability, health and other insurance determined necessary or desirable by you in your sole and absolute discretion. Travel is inherently dangerous and OE cannot and does not make any assurances to you regarding your experience. It is your responsibility to ensure you are complying with all laws wherever you are, including but not limited to destinations you travel to with or on behalf of a family. You must determine, in your sole and absolute discretion, what vaccines, if any, you will get; what travel documents are necessary for you; what health and safety measures you will take; and all other steps you wish to take related to your wellbeing. If you are not comfortable with a family or a destination’s requirements relating in any way to your health, safety, liberty or wellbeing it is up to you to decide what to do.
6. Families’ Privacy and Confidential Information.
The families with whom OE work are very protective of their privacy and information. You warrant that at no time shall you harass, defame, harm, disparage or take any other negative action against any member of a family or its staff and that you will keep families’ identity and personal information confidential. You acknowledge that if you are considered for any position, you will be required to execute certain privacy and confidentiality documents, and that you will not be advanced in the interview or hiring process if you do not sign these when so requested. Nothing in this paragraph is intended to limit your rights to make a complaint regarding a family’s conduct, or that of their staff, to any governmental agency or authority, including but not limited to law enforcement authorities, the Equal Employment Opportunity Commission, or any other applicable body.
